What to Expect in Mediation

Mediation is a confidential, structured process where all parties meet with a neutral mediator to discuss the issues, explore options, and work toward resolution. The session may involve joint discussion, private caucus meetings, or a combination of both, depending on the needs of the case. If the parties reach a settlement, the terms are documented in a written agreement that all parties sign. This agreement becomes a binding resolution of the dispute. If a full settlement is not reached, the mediator will summarize the progress made and identify any remaining issues.

Some mediations result in partial agreements, allowing parties to resolve some issues while continuing to negotiate others. When additional time is needed—whether to gather documents, consult experts, review financial information, or work through emotional or relational challenges—parties may schedule a follow-up mediation session. This continued approach often provides the clarity and breathing room needed to make informed, thoughtful decisions.
